Expert Witness Reports
CPR Part 35-compliant autism psychiatric assessments and ADOS-2 reports for civil, family, criminal, and Court of Protection proceedings.
Comprehensive autism expert witness
reports for UK courts.
Our chambers prepares multidisciplinary autism assessments and ADOS-2 expert witness reports for solicitors under CPR Part 35, FPR Part 25, and CrimPR 19. Members of our chambers include consultant psychiatrists and chartered psychologists with specialist registration in neurodevelopmental disorders.
We accept instructions in civil claims, family proceedings, criminal cases, and Court of Protection matters where autism spectrum disorder is central to diagnosis, capacity, or culpability. Our reports align with the British Psychological Society Code of Ethics, the GMC’s Good Medical Practice, and the Civil Justice Council’s 2014 Guidance for the Instruction of Experts.
Three stages where an autism expert witness
report is critical.
Pre-action & Letter of Claim
Our chambers accepts instructions at the pre-action stage to establish a diagnosis of autism spectrum disorder under DSM-5-TR or ICD-11, supporting the Letter of Claim and informing quantum calculations for future care and support needs.
Court directions & joint statements
The autism assessment report is exchanged under CPR 35.4 or FPR 25.4, forms the basis for joint expert discussions under CPR 35.12, and is relied upon for interim applications in family and Court of Protection proceedings.
Trial & sentencing hearings
In criminal cases, our experts provide fitness to plead assessments and autism psychiatric assessments for sentencing under the Sentencing Act 2020. The report’s reasoning on culpability and mitigation is tested under cross-examination.
What an autism expert witness
report includes.
Expert qualifications & instruction
GMC Specialist Register entry, MRCPsych, HCPC registration, or BPS Chartered status, with the expert’s medico-legal experience in autism spectrum disorder cases and the specific questions posed by the instructing party.
Developmental & educational history
Early developmental milestones, educational records, and historical accounts of social communication difficulties, restricted interests, or sensory sensitivities — establishing the longitudinal trajectory of the presentation.
ADOS-2 assessment findings
The results of the Autism Diagnostic Observation Schedule, Second Edition (ADOS-2), administered by a trained clinician, with clinical observations on social reciprocity, communication, and restricted behaviours.
Collateral information review
Review of GP, paediatric, CAMHS, and adult mental health records, with material entries identified and cross-referenced to the clinical formulation and diagnostic reasoning.
Diagnostic formulation
The expert’s reasoned opinion on whether the presentation meets criteria for autism spectrum disorder under DSM-5-TR or ICD-11, with differential diagnoses addressed and ruled out where clinically indicated.
Capacity & functional impact
Where instructed, an assessment of capacity under the Mental Capacity Act 2005, with specific reference to the functional impact of autism on decision-making, risk, and daily living skills.
Declaration of compliance
The CPR Part 35 declaration, signed statement of truth, and confirmation of the expert’s overriding duty to the court under CPR 35.3, with independence and impartiality expressly acknowledged.
How the autism assessment

Our members document each step of the assessment process transparently, ensuring the methodology withstands scrutiny under CPR Part 35 and joint expert questioning.
