1. How Expert Witness Fees Are Determined

Our chambers prepares medico-legal reports for civil, criminal, family, and Court of Protection proceedings. Expert witness fees in the UK are governed by contractual agreement between instructing solicitors and our members, subject to CPR Part 35 and the Legal Aid Agency’s Remuneration Regulations. The court retains discretion under CPR 35.4(4) to limit recoverable costs between parties, though this does not override private fee agreements.

2. Key Regulations Governing Expert Witness Fees

Instructions accepted by our chambers comply with the following UK frameworks:

  • Civil Procedure Rules Part 35 and Practice Direction 35
  • Legal Aid Agency’s 2024 Remuneration Regulations for legal aid cases
  • Civil Justice Council 2014 Guidance on Expert Evidence
  • Academy of Experts’ fee guidelines for privately funded matters
  • GMC and HCPC professional standards for expert witnesses

3. Professional Body Fee Guidance

Our chambers aligns its fee structures with the guidelines issued by the UK’s leading professional bodies for expert witnesses. These documents provide benchmarks for medical expert witness fees in the UK and are routinely cited in cost disputes.

  • Expert Witness Institute — ewi.org.uk

4. How to Instruct Our Chambers

Instructions to our chambers are accepted via email or secure portal, accompanied by a letter of instruction, medical records, and a signed expert witness agreement. Our members’ standard terms include hourly rates, fixed fees for specific report types, and payment terms of 30 days from invoice date.

For legally aided cases, solicitors must obtain prior authority from the LAA using form CIV APP1. Our chambers provides CVs, sample reports, and fee quotes on request to support the application.

  • Email instructions: info@abuseinjuryexperts.co.uk
  • Secure portal: chambers.secureportal.uk
  • LAA prior authority: CIV APP1 form required
  • Urgent cases: 5-day turnaround available

All instructions are subject to our chambers’ conflict check and capacity review. Fee agreements are signed before work commences.

5. Fee Transparency and Contracts

Our chambers provides written fee agreements for every instruction, detailing hourly rates, fixed fees, and any additional charges for travel, joint meetings, or court attendance. Contracts specify that expert witness fees are payable by the instructing party, regardless of the court’s decision on recoverability under CPR 35.4(4).
